Legal Reminder - Airport Impact Overlay District

You may remember that, in January 2023, Loudoun County updated its zoning ordinance to require sellers and real estate agents to disclose a property’s location in the Airport Impact Overlay District (AIOD) in their marketing materials and in any sales contract for the property, for the purpose of informing prospective buyers of potential airport noise. Thanks to REALTOR® advocacy, a new law was passed in Virginia, effective July 1, 2024, prohibiting localities from establishing or enforcing mandatory disclosure requirements in real estate transactions. Thus, if you have a transaction in Loudoun County, you are no longer required to provide the AIOD disclosure as of July 1, 2024. NVAR will be sunsetting Form K1402 to reflect the new law.
