Article 12, SOP 10 says that Realtors® are prohibited from “presenting content developed by others without either attribution or without permission…” If it was not your client that developed the photos, you need to secure permission from the developer
In addition to the Code of Ethics, the MLS Rules and Virginia law prohibit the use of content developed by others without proper attribution. The MLS Rules state, “A listing may not be advertised by anyone other than the Listing Broker without the prior consent of the Listing Broker,” except in a couple of limited scenarios. (MLS Rule 2.3). Also, Virginia’s copyright laws prohibit an individual from intentionally causing consumer “confusion, mistake, or deception as to the source or origin of any goods or services, without the consent of the owner of a registered mark...” VA Code § 59.1-92.12. Therefore, agents are highly encouraged to seek permission before reusing photos owned by someone else.
